Manzano Munitions Liability Waiver

I hereby assume all risks by agreeing to the following:
1.    That I am voluntarily participating in firearms training by Manzano Munitions, Kyle Manzano, and/or its agents, employees, or legal representatives, collectively known as “MM”.  I recognize that serious and life-threatening injuries can occur from firearms and related equipment and materials including ammunition. I understand that there are various risks involved with shooting activities and that those risks include but are not limited to injuries or death caused by gunshot, the negligence of other participants in the vicinity, faulty equipment, lighting conditions, weather, excessive noise, long distance and/or excessive traffic on route to medical care facilities. 
2.    I represent that I am physically fit and that I have no medical, psychological, or other condition that would impact my ability to fully participate in the firearms class. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in class.
3.    I voluntarily assume full responsibility for any risk of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to my property as a result of my participation in these activities, whether caused by the action or inaction of myself or others. Furthermore, I take full legal and financial responsibility for any damage or harm I may cause to myself, other individuals, rental equipment, range equipment, facilities, or other property that occurs from my actions or inactions as a result of my participation in firearms training with MM.
4.    I, on behalf of my heirs, executors, administrators, partners, agents, brokers, insurers, and assigns, hereby release, acquit, indemnify, and hold harmless MM and its officers, directors, owners, partners, agents, brokers, employees, insurers, assigns, and all other related persons, entities, affiliates, predecessors, and successors, from any and all claims, actions in law or equity, causes of actions, demands, rights, damages, costs, loss of services, expenses, and compensation whatsoever arising from any damage to property, injury, or illness to person, or death (whether predicated upon negligence or otherwise) in connection with the use of training facilities or participation in any activities held, promoted, or otherwise known to MM.
5.    I certify that I am not prohibited from possessing firearms under federal or state law. I am not under indictment in any court for a felony, or for any other crime for which a judge could imprison me for more than one year. Additionally, I agree to the following:
a.    I have never been convicted in any court of a felony or any other crime for which the judge could have imprisoned me for more than one year, even if I received a shorter sentence including probation. 
b.    I am not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.
c.    I am not a fugitive from justice. I have never been adjudicated as mentally defective, which includes a determination by a court, board, commission, or other lawful authority that I am a danger to myself or others or am incompetent to manage my own affairs, nor have I been involuntarily held for a mental health evaluation within the last 5 years. I have never been committed to a mental institution.
d.    I have never been discharged from the armed forces under dishonorable conditions. I am not subject to a court order retraining e from harassing, stalking, or threatening my child or an intimate partner or child of such partner. I have never been convicted in any court of a misdemeanor crime of domestic violence. I have never renounced my United States citizenship and am not an illegal alien in the United States.
e.    I am not under the influence of alcohol or any drug that may impair my ability to operate a firearm in a safe and orderly manner. I affirm that I have refrained from being under the influence of alcoholic beverages or drugs while on property or range being used by MM for firearms training. Further, I understand that the consumption of drugs or alcoholic beverages is expressly prohibited in classes or training with MM, and that any person(s) who, strictly by our observations, appear to be under the influence of alcohol or drugs or otherwise, emotionally unstable, shall be denied access to any classes or training and will be escorted off the premises.
f.    I acknowledge, understand, and will follow all posted and printed Range Safety Rules and any spoken instructions from range personnel. I further acknowledge and fully understand that failure to follow the posted and printed rules will result in my immediate expulsion from any classes or training involving MM.
I agree to all statements listed under clause 5 of this agreement:
6.    Whether or not there are Range Safety Rules posted, all MM training participants, along with any guests, are expected to do the following:  
a.    Be courteous and respectful of others using the range.
b.    Follow Basic Gun Safety Rules: Treat all guns as if they are loaded. Never point a gun toward yourself or another person. Keep your finger off the trigger until you are ready to shoot. Know your target, its surroundings, and beyond. Know how to properly operate your gun before use. Store your gun safely and securely to prevent unauthorized use.
c.    Wear eye and ear protection, even when using scopes or binoculars.
d.    Wear appropriate attire (i.e., shirt, pants, and closed-toe shoes).
e.    Meet minimum age restrictions (i.e., 21+ for handguns and 18+ for long guns). If under these age requirements, a parent or legal guardian’s presence or written permission is required, and person must be coached by a responsible adult (21+ for handguns and 18+ for long guns) within arm’s use of gun used. No children under the age of 7 are allowed on a range.
f.    Never participate in training under the influence of drugs (including cannabis) or alcohol. Additionally, tobacco products should not be used on the range.
g.    Use only guns and ammunition that are legal per state and federal laws when training with MM. 
h.    Remove or dispose of your targets, bullet casings, and trash following your training session. 
I agree to all statements listed under clause 6 of this agreement: 
7.    Manzano Tactical leverages various forms of media, including videos, photos, audio clips, and written testimonials to promote its firearms instruction business through various channels including its website and social media sites such as Facebook and Instagram. I authorize MM to use my image, likeness, voice, and written statements for its program promotions and materials, in paper and electronic formats. 
(If I do not agree with this clause, I will not initial this clause and will discuss my concerns with MM staff.)
